Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Services. By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Our Privacy Policy explains how we handle personal information and is incorporated by reference.

1. Who we are / what PlugLocate is

PlugLocate is a product of Outofbox Solutions. The Services provide an informational directory and discovery experience for electric-vehicle (EV) charging locations, related map/search tools, trip-planning aids, and optional community features.

We are not:

  • A charging station owner, host, or network operator
  • An energy supplier or payment processor for charging sessions
  • A provider of live guaranteed availability, pricing, or reservation services unless we expressly state otherwise in the product

We aggregate and display information from third-party sources and optional user contributions so you can research stations. Choosing where and how to charge remains entirely your responsibility.

2. Eligibility

You must be able to form a binding contract and comply with these Terms. The Services are intended for drivers and EV owners (generally 16+). Do not use the Services if you are prohibited from doing so under applicable law.

3. License to use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial purposes. You may not:

  • Copy, modify, distribute, sell, or lease any part of the Services except as allowed by law
  • Reverse engineer or attempt to extract source code except where permitted by law
  • Scrape, harvest, or automate high-volume access in a way that degrades the Services or violates third-party provider terms
  • Interfere with security, authentication, or moderation systems
  • Misrepresent your identity or affiliation
  • Use the Services for unlawful, harmful, or abusive purposes

4. Accounts

Accounts are optional for core browsing. Certain features (favorites sync, check-ins, tips, photo uploads, profile, and TomTom live port checks) require an account.

You are responsible for providing accurate account information, keeping credentials confidential, and all activity under your account. We may suspend or terminate accounts that violate these Terms or pose security or abuse risks. You may delete your account where the App provides that function, or by contacting support@pluglocate.app. Account deletion removes profile, favorites, check-ins, and tips linked to your account; previously submitted station photos may remain in the shared catalog as described in our Privacy Policy.

5. Third-party data; no warranty of accuracy

5.1 Aggregated information

Station listings, connector types, power levels, access notes, amenities, addresses, maps, routes, Nearby walkable places, and similar information may come from sources including (without limitation) U.S. DOE Alternative Fuel Data Center (AFDC) / NLR-derived data; Open Charge Map and its contributors; OpenStreetMap and related geocoding, tile, and Overpass services; routing services (for example OSRM); TomTom for account-only, on-demand charging-port availability; and other public or licensed datasets and APIs.

5.2 No guarantee

Information may be incomplete, delayed, outdated, or incorrect. Catalog and listed charger status shown in PlugLocate is not guaranteed to be live and may differ from network operator apps, on-site equipment, or real-world conditions. Pricing, hours, access restrictions, payment methods, and connector compatibility can change without notice. TomTom availability is requested on demand by signed-in users, may be served from a server-configured cache, may report “unknown,” and cannot detect all physical damage or vandalism. Nearby places from OpenStreetMap are informational and may omit businesses or show places that are closed.

5.3 Your duty to verify

Before traveling or relying on any listing, you should independently verify critical details with the station operator, host, or network—and at the site itself. Do not rely solely on PlugLocate for safety-critical or time-critical charging decisions.

5.4 No endorsement

Listing a station or network does not mean we endorse it, guarantee service quality, or control its operations.

6. Maps, navigation, and safe driving

Map tiles, geocoding, and route geometry are provided for convenience and may be inaccurate or unavailable. Directions may open third-party apps (for example Apple Maps or Google Maps) that we do not control.

You must obey traffic laws and not interact with the App in a way that distracts you while driving. Navigation and charging decisions are made at your own risk.

7. User content

If you submit photos, tips, check-ins, profile information, or other content (“User Content”), you retain ownership of your User Content, but you grant Outofbox Solutions a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting/moderation), display, and distribute that User Content in connection with operating and improving the Services.

You represent that you have the rights to submit the User Content and that it does not infringe others’ rights or violate law. We may (but are not obligated to) moderate, refuse, or remove User Content—including pending review before public display. We are not responsible for User Content submitted by others.

Do not submit illegal, harassing, deceptive, or unsafe content, or content that includes others’ personal information without permission.

8. Intellectual property and attribution

The PlugLocate name, branding, app UI, and original software are owned by Outofbox Solutions or its licensors. Underlying datasets and map data remain the property of their respective owners and are subject to their licenses (including Open Charge Map CC BY 4.0 attribution requirements and OpenStreetMap contributor rights, as applicable).

You may not use our trademarks without prior written permission, except for nominative reference.

9. Third-party services and links

The Services may link to or interoperate with third-party websites, apps, APIs, and map providers. We do not control and are not responsible for third-party content, terms, privacy practices, uptime, or fees. Your use of third-party services is at your own risk and subject to their terms.

10. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL INFORMATION DISPLAYED ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR UNINTERRUPTED AVAILABILITY.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT STATION DATA, MAPS, ROUTES, AMENITIES, COMMUNITY CONTENT, OR NOTIFICATIONS WILL BE ACCURATE, CURRENT, RELIABLE, OR ERROR-FREE, OR THAT THE SERVICES WILL MEET YOUR REQUIREMENTS.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; IN THOSE CASES, DISCLAIMERS APPLY TO THE FULLEST EXTENT PERMITTED.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTOFBOX SOLUTIONS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, INCLUDING WITHOUT LIMITATION DAMAGES ARISING FROM:

  • Reliance on station, map, route, pricing, availability, or amenity information
  • Travel delays, stranded vehicles, missed appointments, or inconvenience
  • Vehicle, battery, or equipment incompatibility or damage related to third-party charging equipment
  • Actions or omissions of station operators, networks, hosts, or other users
  • Third-party service outages, API changes, or data errors
  • Unauthorized access to or alteration of your transmissions or data, despite reasonable precautions

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US (IF ANY) FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) CAD $50.

SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF CERTAIN DAMAGES; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Outofbox Solutions and its personnel from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or third-party rights.

13. Suspension and termination

We may suspend or terminate access to the Services (in whole or part) at any time if we believe you violated these Terms, if required by law, or if we discontinue the Services. You may stop using the Services at any time. Sections that by nature should survive (including disclaimers, limitations, indemnity, and governing law) will survive termination.

14. Changes to the Services and Terms

We may modify or discontinue features at any time. We may update these Terms by posting a revised version at this URL and updating the “Last Updated” date. Continued use after changes become effective constitutes acceptance, to the extent permitted by law. If you do not agree, stop using the Services.

15. Governing law and venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Subject to applicable consumer-protection rights that cannot be waived, you agree that courts located in Ontario, Canada have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.

16. General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services.
  • Severability. If any provision is unenforceable, the remainder remains in effect.
  • No waiver. Failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale.
  • App stores. If you obtained the App from Apple or Google, you acknowledge those platforms are third-party beneficiaries of applicable store terms between you and the platform, and that Outofbox Solutions—not Apple or Google—is responsible for the App and its content to the extent required by those terms.
  • Language. These Terms are in English. Any translation is for convenience only.
